Fair Use Policy (Broadband, Landline and Mobile)

Our broadband, landline and mobile services are subject to this Fair Use Policy which forms part of our agreement for the provision of these services.


General use (including data):

You must use our services fairly. This means you agree to use them in a way that’s not overly excessive or unreasonable.

If your usage of our phone and internet services:

  • a) materially exceeds our estimated average and/or typical customer usage patterns over any day, week, month, (or other period of time as determined by us);
  • b) is likely to damage or negatively impact the performance of our or our network provider’s network;
  • c) is likely to constitute bullying, nuisance or scamming in breach of our Bullying and Harassment Policy ; or
  • d) is inconsistent with either normal usage patterns and/or the types of uses and purposes for which we communicate our services are designed for,

then we may (acting reasonably and in good faith) deem your usage to be excessive and/or unreasonable.

Megatel and/or our network providers may then request that you stop or alter your usage. In the case of excessive and unreasonable usage of max speed mobile data, we may restrict your mobile data speed to a maximum of 1.2Mbps (meaning you'll still be able to use mobile data but you'll experience some degradation when watching video, streaming or loading images, such as lower video resolution or longer load times).

If your unreasonable usage continues after receipt of a request to stop or alter the nature of such usage, we or our network providers may, without further notice, apply charges to your account for the excessive and/or unreasonable element of your usage and/or suspend or remove the service(s) from your account.


Calls and texts:

Unlimited Minutes and Unlimited Texts are for standard person to person calls to standard landline and mobile numbers in NZ (excludes premium and special numbers) and both parties are connected within a NZ network (excludes roam overseas).

Unlimited Minutes and Unlimited Texts cannot be used for multiple simultaneous calling, re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuous call forwarding, auto-dialling, machine to machine communication (includes using your SIM card in any other device), Cellular Trunking Unites (CTUs), or any other activity that Megatel reasonably considers to be non-standard personal usage (“Prohibited Usage”).

If we consider that you are engaging in Prohibited Usage, we may contact you and ask you to stop such usage. If such Prohibited Usage continues despite notification from us, we may remove your subscription with Unlimited Minutes and/or Unlimited Texts immediately with notice.


Personal / business purposes only:

Where we offer any services under a plan or other service (such as included voice or video calls, text or picture messages, data transfer and internet use via our network), such use is offered for your personal or business purposes only.

In no case does any service allow for activities aimed at making profit from the service itself or reselling the service, and any such use of the services by you in this manner is a breach of this Policy.


Hotspotting:

Where hotspotting / tethering is permitted on a mobile plan, this is intended for use on the account holder’s personal devices and is not to be used excessively for friends, family, or other users’ devices. Mobile data cannot be used as a replacement for home or business broadband services.


Changes to this Policy:

Megatel reserves the right to publish additional terms and/or requirements relating to fair use that apply to some or all of the services which will provide further rules and details around how such services can be used without notice.
